NVF - Neutral Vendor Frameworks (...versus other Frameworks!)

With many years of creativity and experience in providing procurement solutions for both the public and private sectors, we have been both creators and implementors of many framework solutions from a regional and national coverage accessibility.

 

One of the many solutions that we have provided for our public and private sector clientele is that of the hybrid neutral vendor dynamic purchasing system framework (or NVF for short!) and the diagram below gives a brief overview the steps needed to establish an NVF for the benefit of the public sector:-

...what exactly is a NV (Neutral Vendor) Model?

The NV model itself differs from other standard "fixed" models, and is now widely utilised across external client procurement teams that need structure and reliable oversight, and a reliable and robust compliant “vehicle” it can use time and time again.

The “vehicle” itself is normally termed a Neutral Vendor Framework (NVF), however, (if set up on a more agile perspective,) then typically such NVFs become “hybrids” of how a framework operates, and as new suppliers can join an NVF at any time, (unlike a “fixed” framework,) then it takes on the form of a dynamic purchasing system (DPS), that allows quicker turn arounds for “mini-competitions” (aka mini-comp which is an RFQ/RFP style exercise,) and of course, in certain instances, (where there may only be one justifiably suitable supplier,) then a “direct award” without the need for a mini-comp can take place.

The Procurement Agency

The Procurement Agency (aka “procurement services providers” under EU procurement law)

​One of the services we offer, is that of a Procurement Agency which our organisation would be happy to undertake any end to end procurement exercise to establish either a fixed or NV framework on a public or private sector client’s behalf, (or indeed, any procurement exercise or cost saving efficiency initiatives we can assist with,) since we have many years of creativity and experience in providing procurement solutions for both the public and private sectors, which has included many framework solutions from both a regional and national coverage accessibility.

As an organisation, we have been providing solutions to the public and private sectors since 2019, and below are a couple of examples of national frameworks which we undertook for the benefit of the public sector in the UK (one of which was advertised via OJEU, in keeping in line with European public contracts legislation.)

Current and historical examples of frameworks which we have created and/or conducted end to end on behalf of our clientele now follow:-

It wasn’t until 2015, when (pre-company formation,) one of our team, with many years of experience in the public sector, developed and launched the UK’s only second national neutral vendor framework ref PF13/007 Corporate Multi Specialism Services which was advertised on OJEU in 2015, launched and awarded in January 2016 and ended 2020, but not as a competitor of another framework, but as an alternative and enhanced offering to all of the public sector of the UK, which expanded on previous frameworks, by also covering not just professional services, but also goods and works too.

Following the modest success of PF13/007 referenced framework above (in essence mark 1), a second replacement version was created for another public sector client, in the form of the Neutral Vendor &/or Managed Service Provider for the supply of Multi Specialism Services Frameworks, reference 002/1019/OET, which was also accessible for use by not only the public sector client as the Central Purchasing Body, but also to all UK contracting authorities, and once again for all goods, services and works, which was awarded in January 2020 and ended in 2024, with a total duration value of £8 billion.

Since then, we have been part of the continuing success story, to not only our clients, but their clients too.

Summary of Framework
This was highly complex and multi-faceted procurement, comprising of four main lots and 24 sub-lots to establish an agile framework for the purposes of providing its contracted services to HMNB at Portsmouth, KBS sought to enhance and operate an agile supply chain solution to enable a robust, compliant and operationally beneficial call-off protocol from an awarded pool of Tier 1 and Tier 2 subcontractors (suppliers) across various disciplines whom can provide the works, goods and services needed to support KBS as the Contractor stationed at the aforementioned Naval Base.

The creation and drafting of the tender documents pack, and the full end to end procurement exercise itself was managed and conducted by our organisation on behalf of our client Novo-K Ltd https://www.buyingstation.com/ on behalf of their long established client KBS.

Summary of Framework
Designed as a hybrid between a neutral vendor model and a dynamic purchasing system, it was created to simplify procurement for all UK contracting authorities (CAs). It supports both direct awards and mini‑competitions for goods, services, or works. Because suppliers can join at any point during its term, the framework continually opens the door to new providers at local and national levels. This flexibility helps reduce carbon impact while delivering strong value for money, social value gains, and benefits to local economies.

The operation and management of the framework is managed by Constellia Public https://www.constellia.com/ on behalf of AEC.

The framework can be utilised by CAs, VCSE and even private entities.

The mechanism for conducting further mini-competitions or direct award to grant call-offs to framework suppliers can either be done by the client themselves (direct contracting,) or via the MSP (managed service provider) route thus using Constellia Public as the “central/prime contractor” whom can do this on the client’s behalf.

The Framework Host (Public Sector Framework Host - PSFH,) as the recognised owner of the framework, acknowledged that the development, construction, intellectual property and know-how of the framework, its notices, awards and documentation comprising of the tender itself was created by our company as the “Framework Creator” the Framework Creator Procurement Service Provider (FCPSP), of which we have reserved delegated authority rights as a third party to act on behalf of the PSFH (and its heirs and successors,) and as such, both the PSFH and the FCPSP have the right to draft, appoint, terminate, suspend, mediate and arbitrate any agreements whatsoever used in the delivery of the of the framework, and of course issue any modifications to the original framework itself.

Constellia Public as the awarded “framework “manager.” (FMPSP), onboards suppliers to its platform who then become the “pool” of providers to clients for goods, services and works. As the FCPSP, we can also support the FMPSP in that task too.

Both the PSFH and the FCPSP have the right to appoint and terminate the awarded FMPSP(s) to this framework and framework partners suppliers who join the framework, and act on behalf of any entity (client, contracting authority or non contracting authority,) in the execution and operation of this framework.

...and one final note...
